A few months back, fitness tech brand Fitbit was served a lawsuit pertaining to injuries sustained by a number of users caused by Fitbit Versa smart wearables, which caused skin burns and irritation. It now seems that a new case has been filed in an Australian court against Fitbit, this time for alleged misleading claims towards customers.
More specifically, the Australian Competition and Consumer Commission (ACCC) has begun court proceedings against the company, saying that Fitbit advised consumers that they will not be entitled to a refund unless they returned a faulty product within 45 days of purchase or shipment, which apparently is in not in accordance with Australian Consumer Law. This supposedly happened between May 2020 and February 2022.
Australian Consumer Law does not impose a 45-day refund period, as consumer rights are not dependent on the original purchase date of faulty goods. According to the ACCC, there are currently 58 claims of consumers alleging that they were presented with the said Fitbit policy after complaining about faulty devices.
At the moment, there’s no official word from Fitbit regarding the matter, although we can expect some updates in the coming days or weeks regarding this issue.
